DeSantis Vows Florida ‘Will Not Comply’ With New Title IX Rules for Trans Students

Florida Gov. Ron DeSantis is pushing back on the Biden administration’s rule change involving transgender primary school students, vowing that he won’t comply with any part of it.

The Biden administration last week introduced new regulations for transgender students under the umbrella of Title IX. These regulations aim to prohibit schools from mandating that students use bathrooms corresponding to their assigned gender at birth.

The new rule makes it “crystal clear that everyone can access schools that are safe, welcoming and that respect their rights,” Education Secretary Miguel Cardona said, without explaining how the rule change makes it “safe” and “welcoming” to the vast majority of students who are gender-confused.

“No one should face bullying or discrimination just because of who they are, who they love,” Cardona told reporters on April 19. “Sadly, this happens all too often.”

But DeSantis made it clear in response to the announcement that no one entity, including the federal government, has a right to discriminate against kids who are not ‘struggling’ with their gender identity.

“We are not gonna let Joe Biden try to inject men into women’s activities,” DeSantis said Thursday on X. “We are not gonna let Joe Biden undermine the rights of parents. And we are not gonna let Joe Biden abuse his constitutional authority to try to impose these policies on us here in Florida.”

He added: “We will not comply.”

Biden’s rule change comes on the heels of a stunning report issued last week in Great Britain. The Cass Report examined over 9,000 patient records of transgender youth and reached several striking conclusions. Among its findings, the report suggests that individuals under the age of 18 should not undergo any form of gender-affirming treatment, including hormone injections, and emphasizes the need for “great caution” when considering such interventions for patients under 25.

The report provided various recommendations to enhance care but ultimately concluded that “for most young people, a medical pathway will not be the best way to manage their gender-related distress.” As a result, the NHS has reversed its longstanding practice of prescribing puberty-suppressing hormones (PSH) to children with gender dysphoria—a condition characterized by a significant incongruence between one’s experienced/expressed gender and assigned gender for a duration of at least six months, as outlined in the Diagnostic and Statistical Manual of Mental Disorders.

“We have determined that there is insufficient evidence to support the safety or clinical effectiveness of PSH to justify its routine availability at this time,” stated the NHS last month. Although PSH treatment will still be accessible for participants in clinical trials and at private clinics, some British lawmakers are now advocating for a universal ban on its use.

Among the report’s findings was the smashing of the transgender lobby’s most cherished myth: that unless kids get “gender transition care,” including hormones, they are at risk of suicide.

In fact, a study done in Great Britain by “Michael Biggs” showed that there were only four suicides among 15,000 adolescents over a ten-year period. The common myth pushed by the transgender lobby is that “more than half” of transgender kids attempt suicide.

Here’s what the rules require, per City Journal.

To begin, under the Biden administration’s guidelines, a boy who identifies as a girl must be given access to girls’ bathrooms or locker rooms. Since the administration does not mandate any documentation to validate gender identity and, indeed, refrains from defining gender identity altogether, a boy could assert his identity as a girl interchangeably. The federal government guarantees his right to identify as a girl specifically when he enters a girls’ bathroom.

Furthermore, teachers and students are required to address a gender dysphoric child by their preferred pronouns and alternative name. The Biden regulation generously acknowledges that an occasional “misgendering” incident does not inherently breach Title IX.

However, based on logic and the administration’s historical enforcement practices, if multiple individuals consistently “misgender” a student, or if an individual repeatedly does so, the school faces the potential risk of losing all federal funding unless the situation is rectified, the outlet noted.
