Former President Donald Trump got a big victory against Manhattan Supreme Court Justice Arthur Engoron in his New York civil trial, and he and his family are celebrating.
A New York appeals court judge halted the breaking up of Trump’s corporations but did not stop the civil fraud trial from continuing, CNN reported.
“We are very pleased the First Department upheld New York law and put a halt to any cancellation of business certificates, receivers or dissolution,” Trump attorney Christopher Kise said. “The trial court’s attempt to reach issues, entities and assets beyond the scope of this case has been suspended.”
CNN reported:
Engoron had ordered Trump to propose potential receivers by October 26, which would begin the process of dissolution.
During the hearing, Moulton speculated that such a broad interpretation of Engoron’s ruling could mean LLCs holding the private homes of Trump and the other defendants could be at risk of being sold.
“[Engoron] clearly does not comprehend the scope of the chaos its decision has wrought,” Trump’s lawyers said in a court filing earlier in the day.
“We’re not seeking delay. We’re not seeking anything but a fair trial and these errors permeate the ongoing trial,” Kise said in court, referring to “an avalanche of errors” in the summary judgment ruling.
Trump’s legal team believes the appellate court could eventually reverse at least part of Engoron’s bombshell order and gut New York Attorney General Letitia James’ case by dismissing a majority of the lawsuit’s claims that they believe are time barred by an earlier appellate ruling handed down in June.
Eric Trump, the son of the former president, responded to the decision in a post on X, formerly Twitter.
“We thank the Appellate Division for staying the NY Attorney General’s and Judge Engoron’s overzealous attempt to cancel our New York business certificates. Judge Engoron’s order erroneously sought to adjudicate the rights of non-party business entities that employ nearly 1,000 hard-working New Yorkers, have never been accused of any wrongdoing and, were never given their day in court – in clear violation of their fundamental Constitutional rights and Due Process. We will continue to vigorously defend our company and our incredible employees from this politically-motivated persecution,” he said.
Engoron, who is overseeing New York Attorney General Letitia James’ civil fraud trial against the former president and his family, exhibited more bizarre behavior during a court session on Thursday, launching a mini tirade at Trump’s legal team.
The judge slammed a hand down on his table during a cross-examination of a witness after he obviously grew annoyed at the line of questioning, according to the New York Post.
Trump’s lawyers were getting very technical with Mazars USA partner David Bender when Engoron exclaimed, “This is ridiculous!” after the president’s attorneys accused Bender of refusing to answer questions.
“Don’t waste time,” he added as Trump’s attorneys tried arguing that they had to go through their client’s records “year by year” with the witness.
Trump’s attorneys had already spent “part of Tuesday afternoon and all of Wednesday morning” parsing Bender’s testimony, The Post noted. When they advised that he would remain on the stand for the rest of the day, that’s when Engoron lost his temper.
“This is ridiculous!” he said, adding: “Mr. Bender isn’t on trial here.”
“We need to be allowed to parse the evidence,” Trump attorney Christopher Kise argued in response, according to The Post. “We didn’t bring this case.”
“We haven’t got one answer from him,” another Trump attorney, Alina Habba, added. “He has no memory as we sit here.”
At one point, Kise agreed “to streamline” the questioning, which led Engoron to respond, “Let’s not waste time.”
Engoron indicated that Trump’s legal team appeared to be employing courtroom theatrics designed to make an impact on a jury or possibly the media but that these tactics were not conducive to a bench trial where the judge alone would make the ultimate decision.
“There is no jury here,” he told the Trump team at least once, according to the report. He then asked: “Who are you talking to — me, the press or the audience?”
