A federal judge just delivered a crushing blow to Democrats in their attempts to stop President Donald Trump from protecting America’s Southern border.
The American Civil Liberties Union brought a case in July, claiming that the administration was separating families, going back on its pledge not to.
The judge granted the ACLU a preliminary injunction at the time but on Monday when the court rendered its decision that was done, Reuters reported.
The judge said that the Trump administration had the authority to separate families at the border and that is was not violating the “rights to family integrity.”
“The Court finds Defendants are generally exercising their discretion to separate families at the border consistent with Plaintiffs’ rights to family integrity and the Court’s orders,” U.S. District Court Judge Dana Sabraw said.
The same judge, in 2018, said that immigration authorities could not separate families that had crossed the border illegally and that those that were would have to be reunited immediately.
On Monday Judge Sabraw said that the court should not “second-guess” the decision made by the administration and that it was using its “discretion and judgment in a reasonable manner” in what it was doing.
The ACLU found a way to somehow make the court’s decision sound like a win while still saying it was contemplating what to do next.
“The court strongly reaffirmed that the Trump administration bears the burden if it attempts to separate families based on an accusation that the adult is not the child’s parent,” Lee Gelernt, an attorney for the ACLU said.
“We are evaluating the decision to determine next steps on how to ensure that children are not separated from their parents based on minor infractions,” he said.
Crossing the border illegally is not a “minor infraction.” Not only does it place an undo burden on the American taxpayers there are other issues at hand.
A porous border is a detriment to national security. When a nation cannot control who enters it makes it incredibly tough to stop terrorists.
It also accomplishes the Democrat’s main goal of creeping the United States closer to becoming a one-party state by changing the electoral map.
It is likely that the ACLU will continue to pursue its efforts to stop the administration from exercising its right to protect American sovereignty.
But if it gets to the Supreme Court, President Trump has a distinct advantage with a 5 -4 conservative majority.
It is just one disappointment after another for Democrats.
