Federal Judge Gives Trump HUGE Win – POTUS Can Do It

The Trump administration has just scored a major legal victory, with a federal judge upholding its policy on family separation.

A federal judge ruled Monday that the Trump administration is operating within its authority when separating families stopped at the Mexican border.

The American Civil Liberties Union argued that the administration was splitting families over dubious allegations and minor transgressions including traffic offenses, the Washington Times reported.

It asked the judge in July to rule on whether the government was justified in separating 911 children during the first year after the judge halted the general practice in June 2018.

U.S. District Judge Dana Sabraw indicated he was uncomfortable second-guessing government decisions to separate children on grounds that parents were considered unfit or dangerous, or in other limited circumstances like criminal history, communicable diseases and doubts about parentage.

The judge also found no evidence that the government was abusing its discretion.

“It is an invitation that is potentially massive in scope, invades an area that is particularly within the province of the Executive Branch to secure the Nation’s border, and goes beyond this Court’s class certification and preliminary injunction orders, which were focused on the Administration’s practice of separating families at the border for the purpose of deterring immigration, and failing to reunify those families,” Sabraw wrote in a 26-page decision.

In June 2018, the same judge halted the practice of separating families under a “zero tolerance” policy to deter illegal immigration and ordered they be quickly reunited.

Lack of adequate tracking systems at the time made reunification a monumental task.

The government argued it separates families when it suspects the parent has a “criminal record, a communicable disease, or when there are questions about the relationship between the adult and the migrant child.”

The government also made it clear that the current practice is no different than prior administrations, including the Obama administration.

This is a big win for the Trump administration.

For starters, it speaks volumes that a judge in liberal California ruled in favor of Trump. He said the administration is within its authority to separate families stopped at the border.

The judge pointed to the fact that many of these parents are dangerous or have a criminal history.

These are people who think they can use their kids as pawns to get into America.

While securing the border and continuing to build more of the wall between the U.S. and Mexico remains a top priority, the administration is also focusing on internal issues.

Combating illegal immigration starts with forcing local authorities in these left-wing states like California and New York to turn illegal alien criminals over to ICE, instead of turning them loose on Americans and then protecting them after they commit crimes.

In many Democratic-controlled states, illegals have more rights than U.S. citizens.

This ruling gives the president even more momentum going into the 2020 election.
