Trump Attorney Predicts US Supreme Court Will Overturn Colorado Ballot Ruling

Former President Donald Trump’s legal spokeswoman predicted that the Colorado Supreme Court’s decision to boot him off the 2024 ballot will not be allowed to stand by the nation’s highest court.

“I find it ironic that there’s a January 6 charge pending, but due process doesn’t matter because Colorado’s liberal judges want to take him off the ballot because they can’t beat Biden in the ballots,” attorney Alina Habba told “Breitbart News Daily” on SiriusXM, explaining that it is “not a constitutional decision” and “it will be overturned by the Supreme Court.”

The Colorado court removed Trump under the 14th Amendment’s “insurrection” ban, though he has never been charged with that crime, much less convicted of it. The verdict was 4–3.

The decision will remain on hold until January 4th, when an appeal is considered. The nation hopes that the US Supreme Court will hear the case and reach a final decision by then, CNN reported.

The landmark decision will shake up the presidential race in 2024, even though it only applies to Colorado. Officials in Colorado’s election office have stated that a resolution is required by January 5, the statutory deadline for determining the Republican primary contenders.

Post-Civil War ratification of the 14th Amendment prohibits “engaged in insurrection” from holding public office for officials who pledge allegiance to the Constitution. Aside from its ambiguous language and lack of specific reference to the presidency, this provision has seen only two applications since 1919.

Democratic governors of Colorado appointed all seven justices to the state’s highest court. To remain on the bench, six of the seven judges went on to win statewide retention elections. The seventh has not yet been put to the vote since she was appointed in 2021.

In her Breitbart interview, Habba added that there is “no question in my mind” that the U.S. Supreme Court will overturn the Colorado ruling.

She added that, to her thinking, it is another case of judges attempting to make a name for themselves while viewing themselves as “pioneers for the liberal radical left.”

“You’re not a pioneer. You’re going to look ridiculous. You do not understand due process. You do not understand the Constitution. You are a state-level court that is going to look ridiculous, okay? When the Supreme Court—whether you’re a federal judge or a state judge—overturns you, that’s not a good look,” Habba said.

“And there is no question in my mind. Due process exists for a reason. There has to be some America left,” she continued, opining that she believed the ruling was absolutely “ridiculous.”

“I’m not even concerned that the Supreme Court will make the right decision here,” Habba continued, saying that every left-wing legal determination and lawsuit “flies in the face of any kind of rational, legal mind.”

“It’s ridiculous, and it’s so desperate. It’s just so desperate,” she continued, saying that every seemingly politicized ruling against Trump only drives more voters to him, especially Independents who see him being politically persecuted.

“We don’t even have the option in Colorado to vote for who we want. The leading candidate, we don’t even have the option because they’re so afraid,” she said, blasting the “anti-American, self-interested behavior that they will go as far as to take away your option to vote for President Trump.”

“That is so sad and pathetic, frankly. I mean, it’s just ridiculous. I have no words. I’m rarely speechless, as you know. But I am speechless,” Habba continued, refuting Democrats’ claims that the ruling is about “protecting democracy.”

Instead, it is “about stealing 2024 because they can’t win,” she said.

“So they already did the Russia hoax. They got caught on that. So now we have to do something different. That’s what this is. The radical left is desperate, and it’s obvious and pathetic,” she added.
