Legal Expert Blasts NY AG James Over Trump Prosecution: ‘Losses No One Suffered’

A legal expert and former federal prosecutor ripped New York Attorney General Letitia James over her prosecution of former President Donald Trump, claiming she is going after him over “losses no one ever suffered.”

In an op-ed, Andrew McCarthy, who is not a fan of the 45th president, accused James of inventing crimes to “get Trump.”

James filed a $250 million civil lawsuit against the former president and his company, the Trump Organization, earlier this year, alleging he inflated the value of his assets in order to get more favorable loan and insurance rates, accusing him of fraud.

Trump has countered that none of the banks and other companies he did business with over the years ever lost money or were financially injured in any way.

McCarthy essentially supports Trump’s argument, writing in National Review: “The case against the former president lacks victims, so Tish James and Arthur Engoron are inventing some.”

The former prosecutor went on to note that if Trump had really defrauded banks out of more than $168 million, they would have no doubt sought legal remedy from him, but they never did that because they never lost money.

“That is not stopping elected progressive Democrats Letitia James and Arthur Engoron, the state attorney general and her cat’s paw in a judge’s robe, from concocting a mammoth fraud scheme masterminded by Trump in which we’re to believe the banks lost their shirts . . . but just forgot to complain about it,” he wrote.

He went on to note that Engoron ruled before the trial even started that Trump had indeed committed fraud, leaving him “no incentive to litigate as if he were in a normal legal proceeding.” As such, Trump has been left to spar with the judge and the prosecutors to demonstrate that it is little more than a partisan proceeding, McCarthy wrote.

After listing a litany of arguments that put the James-Engoron theory to shame, McCarthy concluded: “It’s an amazing thing to watch: Donald Trump, front-runner in the Republican presidential nomination race, is on trial for supposedly inventing wealth that he didn’t have; and in order to nail him, elected Democrats Tish James and Arthur Engoron are inventing losses that no one ever suffered.”

Recently, after a court appearance, Trump continued his criticism of James, ripping her for “smirking” in the courtroom.

In a post to his Truth Social platform, he began, “Racist A.G. Letitia James is smirking all day long from her seat in Court, as New York continues to set records in murder and other violent crimes, and businesses flee to other States.”

He added:

“‘This is a law that’s rather bazar [sic], this is a law that doesn’t require any victims (there are none, except me!), it doesn’t require anyone to lose money – the banks didn’t complain here, they made money. You have a (Trump Hating!) Attorney General who’s seeking hundreds of millions of dollars in damages when not a single penny was lost by these banks, and that’s part of this (Unconstitutional!) Law…You can see from the reaction of A.G. James, every morning from that seat, that she is enjoying this, enjoying it a bit too much.’ Law Professor Jonathan Turley. Reports noted that James was spotted smirking as Donald Trump Jr. took the witness stand in a New York City courtroom.

Don Jr. also tore into James and predicted that New York City would “beg” businessmen like his father to return after many have bailed on the Big Apple in recent years due to rising quality of life issues.

“This is about the attorney general going after and prosecuting her political enemies,” Don Jr. declared, adding that the financial statement that was at the center of the case had nothing to do with him or his brother Eric Trump.
