A post on the X platform containing a court filing from former President Donald Trump makes a serious claim against Fulton County District Attorney Fani Willis that could see her ejected from her RICO case against him.
The user Techno Fog, who has “lawyer” in the account’s profile, noted that “Latest Trump filing in the GA RICO case makes a great point – DA Fani Willis violated GA ethics rules by publicly accusing the defendants of racism after they noted her affair with Special Prosecutor Nathan Wade. Trump: stoking racial division requires dismissal.”
The X post contains a video clip of Willis suggesting that criticisms of her over allegations she had an affair with Nathan Hale, a special prosecutor she hired for the case, and misused county tax funds in making outsized payments to him as the couple went on several trips together, are racist.
“Rule 3.8 requires Willis to refrain from allegations ‘that have a substantial likelihood of heightening public condemnation of the accused,'” the Techno Fog account noted in another post containing screenshots of Trump’s legal filing. “Rule 3.6 forbids statements that would ‘materially’ prejudice a proceeding.
“Clear violation; the only question is the appropriate remedy,” the account noted further.

The account added in another X post: “There’s also a Constitutional argument that the parties need to make – that Willis violated their right to a fair trial.
“As the Supreme Court has noted: Few, if any, interests under the Constitution are more fundamental than the right to a fair trial by ‘impartial’ jurors, and an outcome affected by extrajudicial statements would violate that fundamental right.”

Meanwhile, The Federalist reported in September that Willis is in possession of exculpatory evidence exonerating several of the so-called “fake electors” she has charged in the case.
The GOP-controlled Georgia Senate on Friday voted to form a new committee to investigate Willis.
“A resolution senators passed 30-19 along party lines will create a special committee with subpoena power to probe the allegations against Willis, who obtained an indictment last August accusing Trump and 18 others of trying to overturn the 2020 presidential election in Georgia that saw Democrat Joe Biden carry the Peach State” over Trump, the Macon-based Telegraph newspaper reported in online editions.
Earlier this month, allegations against Willis emerged in a motion submitted to the Fulton County Superior Court on behalf of Michael Roman, one of the defendants in the case. Willis has not directly responded to the charges yet but is expected to submit a response to the court by the February 2 deadline.
On Friday, Senate Republicans stated that probing Willis’ supposed inappropriate connection with special prosecutor Nathan Wade is within the purview of Georgia lawmakers. They justified it by noting that Wade has received almost $654,000 in legal fees via public taxpayer funds to pursue the case since January 2022.
“I am deeply troubled by the poor judgment of our D.A., Fani Willis,” state Sen. Brandon Beach, R-Alpharetta, told his colleagues on the Senate floor before Friday’s vote, the outlet reported. “I believe this scheme … was a fraud against the court and a fraud against the taxpayer.”
“This resolution is about an officer of the state of Georgia … and how they are using state funds,” Sen. Greg Dolezal, R-Cumming, the measure’s chief sponsor, said. “This falls squarely within what we should be talking about and what we should be addressing.”
The committee will consist of nine members, three of whom must be Democrats.
The judge presiding over her case against Trump has ordered an investigation into her alleged misconduct, The Washington Post also reported earlier this week.
