Trump’s lawyer, Alina Habba, stated in an interview on Thursday that she anticipates facing an “onslaught of litigation” with less than 35 days remaining until the presidential election.

Habba’s comments came in response to special counsel Jack Smith’s 165-page filing, which was unsealed on Wednesday by U.S. District Judge Tanya Chutkan in Washington, D.C. Trump’s campaign has contended that Smith’s prosecution regarding Trump’s actions on January 6, 2021, is politically motivated, The Hill reported.

In an interview with Jesse Watters of Fox News, the attorney and spokeswoman for former President Donald Trump called the actions by the Department of Justice an act of “desperation.”

“The Department of Justice has been complicit, and we’ve said this numerous times, but Americans pay attention: We have 30-plus days until an election. We are going to be hit with an onslaught of fake news. We are going to be hit with an onslaught of litigation,” Habba told Watters.

“We have to understand one thing: This is called desperation,” Habba added.

Before the Biden-Harris administration, the DOJ had followed a policy of not engaging in any legal action 60 days before an election during election years, but that appears to have been disregarded.

The 165-page filing unsealed on Wednesday provided new claims into the former president’s alleged attempts to dispute the election results in some states following the 2020 election.

The document outlined a strategy for Smith’s election interference case against Trump, following the Supreme Court’s ruling that former presidents retain immunity when exercising core constitutional powers and are generally presumed immune for other official actions.

Trump blasted the Justice Department Wednesday for having “disobeyed their own rule in favor of complete and total election interference” after pleading not guilty to the new set of charges.

“For 60 days prior to an election, the Department of Injustice is supposed to do absolutely nothing that would taint or interfere with a case,” Trump posted in all capital letters to his Truth Social. “They disobeyed their own rule in favor of complete and total election interference.”

“I did nothing wrong, they did!” he continued. “The case is a scam, just like all of the others, including the documents case, which was dismissed!”

The former president further ripped Democrats, saying they are “weaponizing the Justice Department against me because they I know I am WINNING, and they are desperate to prop up their failing candidate, Kamala Harris.”

Trump claimed that the unsealing of the Smith filing, which he referred to as the “latest ‘hit job,'” occurred because his running mate, Sen. JD Vance, “humiliated” Harris’ running mate, Minnesota Gov. Tim Walz, during the vice presidential debate on Tuesday night. Trump added that the Justice Department “has become nothing more than an extension of Joe’s, and now Kamala’s, campaign.”

“This is egregious PROSECUTORIAL MISCONDUCT, and should not have been released right before the Election,” Trump said. “The Democrat Party is turning America into a Third World Country that tries to censor, harass, and intimidate their Political Opponents. What they have done to our Justice System is one of the Great, All Time, Tragedies.”

The 45th president added that the Democrat Party, in general, “is guilty of the Worst Election Interference in American History.”

“They are trying to DESTROY OUR DEMOCRACY, allowing millions of people to enter our Country illegally. They are determined to stop us from winning back the White House, sealing the Border, and MAKING AMERICA GREAT AGAIN. BUT THEY WILL FAIL, AND WE WILL SAVE OUR NATION!” Trump wrote.

“‘TRUMP’ is dominating the Election cycle, leading in the Polls, and the Radical Democrats throughout the Deep State are totally ‘freaking out.’ This entire case is a Partisan, Unconstitutional, Witch Hunt, that should be dismissed, entirely, just like the Florida case was dismissed!” Trump added.
