The lawyer-spokeswoman for former President Donald Trump is defending remarks she made about Supreme Court Justice Brett Kavanaugh after left-wing commentators and some Democrats criticized her last week.
In an interview with Fox News host Sean Hannity, Alina Habba said that when it comes to the Supreme Court’s decision regarding Trump being removed from the ballot in Colorado by that state’s highest court, Kavanaugh will “step up” to rule in favor of Trump, who continued backing Kavanaugh during a highly contentious nomination process in which a number of disproven sexual allegations about his past were made.
The justices earlier this month agreed to take the case involving the Colorado Supreme Court’s 4-3 decision to remove Trump from the 2024 ballot, citing the insurrection clause of the 14th Amendment after Trump’s legal team filed an emergency motion.
Trump appointed three current justices to the Supreme Court: Neil Gorsuch, Kavanaugh, and Amy Coney Barrett, in that order, giving the high court a solid constitutional originalist leaning.
In her interview with Hannity, Habba stated that Kavanaugh should rule in favor of Trump in the Colorado decision because the former president “went through hell” to get the judge appointed.
“It should be a slam dunk in the Supreme Court. I have faith in them. People like Kavanaugh, who the president fought for, who the president went through hell to get into place, he’ll step up,” Habba said. “Those people will step up not because they’re pro-Trump, but because they’re pro-law, because they’re pro-fairness, and the law on this is very clear.”
A number of liberals criticized Habba’s remarks on social media, accusing her of attempting to pressure Kavanaugh to vote in favor of Trump or suggesting he would decide based on perceived loyalty to the former president.
But Habba dismissed the criticism in a follow-up interview with Newsweek.
“As I have stated multiple times, the Constitution and law speak for itself, and I believe every justice will decide on this clear-cut issue fairly,” Habba told Newsweek.
“Left-wing media’s attempt to intimidate judges who have been put through rigorous vetting due to who they were appointed by is ridiculous, and that is exactly why I addressed it. This is about the Constitution and due process, nothing else,” she added.

Previously, Habba told Newsmax TV that the reason why Trump attended so many hearings in the civil fraud trial brought by New York Attorney General Letitia James is because the case is very important to him.
“It’s a very big deal, and it’s very important to him,” Habba said on Newsmax. “His entire life was not the presidency. The Trump Organization was Donald Trump, so this is important to him, and I think it sends a good message to New Yorkers and the world that, at the end of the day, he’s a human being. He’s an American. He has a business. He’s trying to make money.”
She added that Trump wants the business he started to thrive and that he’s “worth billions more than what’s on his statement of financial condition.”
Habba spoke about James, accusing her of “ignoring the streets of New York and is doing this, in my opinion, for political gain. [She] campaigned in 2018 on getting Donald Trump, and we’ve got the campaign video to prove it.”
“They have nothing to hide,” Habba commented. “There wasn’t an injured party. Everybody made money. The loans were paid back. Ultimately, we have a statute of limitations for a reason. This judge is allowing things that have expired, dating back to as long as 2011. What’s the strategy there?”
